Terms of Service

You must be at least 13 years old to use Sunplan. If you're under the age of majority where you live, you may only use Sunplan with a parent or guardian's permission. You can't use Sunplan if you're barred from doing so by applicable law.

• Give accurate information when you sign up, and keep it up to date.
• Keep your sign-in details secure. You're responsible for activity on your account.
• Tell us promptly at hello@sunplan.io if you think your account has been compromised.

You agree not to:

• break any law, or use Sunplan to infringe or violate anyone else's rights;
• access, or try to access, other people's accounts or data;
• interfere with or disrupt the Service, including by overloading it, introducing malware, or getting around its security, rate limits or access controls;
• scrape, copy or reverse-engineer the Service, except where the law allows it;
• use Sunplan to build a competing product, or resell access to it.

You own the plans and other content you add to Sunplan (“Your Content”). You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process and display Your Content only as needed to operate, maintain and improve the Service for you. This license ends when you delete Your Content or your account, except for copies in routine backups that are deleted on their normal schedule.

You're responsible for Your Content, and you confirm you have the right to add it. We may remove content that breaks these Terms or the law.

Sunplan, including its software, design, logo and name, belongs to us and is protected by intellectual property laws. We give you a personal, limited, non-exclusive, non-transferable and revocable license to use the Service as these Terms allow. We keep all rights not expressly granted.

If you send us ideas or suggestions, we may use them freely, without any obligation to you.

Sunplan uses services from other companies, including Google Maps. Your use of Google Maps features is also subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy. We aren't responsible for third-party services, and they may change or become unavailable.

Sun hours, shade, weather-adjusted sunlight, frost dates and hardiness zones in Sunplan are estimates, based on the shapes you draw, solar geometry and historical data. Real conditions vary. Sunplan is a planning aid, not professional gardening, landscaping, agricultural, engineering or construction advice, and you use its estimates at your own discretion.

Sunplan is currently free. If we introduce paid features, we'll tell you in advance and explain the terms, and you won't be charged unless you choose to sign up for them.

We may change, add or remove features, or stop offering the Service. If we plan to shut Sunplan down, we'll give reasonable notice where we can, so you can download your data.

We may update these Terms. We'll change the date at the top, and for material changes we'll notify you by email or in the app before they take effect. Continuing to use Sunplan after that means you accept the updated Terms.

You can stop using Sunplan and delete your account at any time from your account page. We may suspend or close your account if you break these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive (such as 5, 6, 12, 13, 14, 15 and 16) continue to apply after your account ends.

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise the Service will be uninterrupted, error-free or secure, or that its estimates will be accurate.

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, crops or plants, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of US$100 or the amount you paid us for the Service in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you.

To the extent permitted by law, you agree to defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from Your Content, your misuse of the Service, or your breach of these Terms.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If a dispute comes up, please email us first. We'll try to resolve it informally within 30 days. If we can't, the dispute will be decided exclusively by the state or federal courts located in San Francisco County, California, and you and we consent to their jurisdiction. Either of us may bring a qualifying claim in small claims court instead. Nothing here limits rights you have under the consumer laws of where you live.

• These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
• If any part of these Terms is found unenforceable, the rest stays in effect.
• If we don't enforce a part of these Terms, that isn't a waiver of our right to do so later.
• You may not transfer these Terms without our consent. We may transfer them in connection with a merger, acquisition or sale of Sunplan.
• We aren't responsible for delays or failures caused by events outside our reasonable control.
